2. General Information on Data Processing
We process personal data of our users only to the extent necessary to provide a functional website as well as our content and services. The processing of personal data of our users takes place regularly only with the consent of the user. An exception applies in cases where obtaining prior consent is not possible for factual reasons and the processing of the data is permitted by law.
3. Legal Basis for Processing
Insofar as we obtain the consent of the data subject for processing operations involving personal data, Article 6(1)(a) GDPR serves as the legal basis.
When processing personal data that is necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures.
Insofar as processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) GDPR serves as the legal basis.
If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights, and freedoms of the data subject do not outweigh the first-mentioned interest, Article 6(1)(f) GDPR serves as the legal basis for the processing.
4. Data Erasure and Storage Duration
The personal data of the data subject will be erased or blocked as soon as the purpose of storage ceases to apply. Storage may continue if this has been provided for by the European or national legislator in Union regulations, laws, or other provisions to which the controller is subject. Data will also be blocked or erased when a storage period prescribed by the aforementioned standards expires, unless there is a need to continue storing the data for the conclusion or performance of a contract.
5. Provision of the Website and Creation of Log Files
Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing device. The following data is collected:
• Browser type and version used
• The user's operating system
• The user's Internet service provider
• The user's IP address
• Date and time of access
• Websites from which the user's system accesses our website (referrer)
• Websites accessed by the user's system through our website
The data is stored in the log files of our system. This data is not stored together with other personal data of the user.
The legal basis for the temporary storage of the data and the log files is Article 6(1)(f) GDPR. The storage in log files takes place to ensure the functionality of the website. The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected.
6. Hosting
Our website is hosted by Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (“Shopify”). Shopify processes personal data on our behalf which arises during the visit and use of our online shop. We have concluded a data processing agreement (Data Processing Addendum) with Shopify.
Shopify may transfer data to the USA and other countries. The data transfer is based on the Standard Contractual Clauses of the EU Commission. For details, please refer to Shopify’s privacy policy at: https://www.shopify.com/legal/privacy
The legal basis is Article 6(1)(f) GDPR. Our legitimate interest lies in the reliable and secure provision of our online shop.
7. Use of Cookies
Our website uses cookies. Cookies are text files that are stored in the internet browser or by the internet browser on the user’s computer system.
Technically necessary cookies are set on the basis of Article 6(1)(f) GDPR in conjunction with Section 25(2) of the German Telecommunications and Telemedia Data Protection Act (TDDDG). We have a legitimate interest in storing technically necessary cookies, as without these the operation of our website would not be possible.
Cookies that are not technically necessary (e.g., for analysis or marketing purposes) are only set with your express consent pursuant to Article 6(1)(a) GDPR in conjunction with Section 25(1) TDDDG. You can withdraw your consent at any time via our cookie consent banner.
8. Customer Account and Order Processing
When you place an order in our online shop or create a customer account, we collect the following personal data:
• Salutation, first name, last name
• Email address
• Delivery address and, if applicable, billing address
• Payment information
• Phone number (optional)
The legal basis for the processing of this data is Article 6(1)(b) GDPR, as the processing is necessary for the performance of the purchase contract. After complete processing of the contract, your data will be blocked for further use and deleted after the expiry of the retention periods under tax and commercial law (usually 6 or 10 years), unless you have expressly consented to further use.
You can delete your customer account at any time. To do so, please send a message to service@fabiofarini.de.
9. Transfer of Data to Third Parties
A transfer of your personal data to third parties for purposes other than those listed below does not take place. We only pass on your personal data to third parties if:
• You have given your express consent to this (Article 6(1)(a) GDPR),
• The transfer is necessary for the performance of the contract (Article 6(1)(b) GDPR), in particular to shipping service providers and payment providers,
• There is a legal obligation for the transfer (Article 6(1)(c) GDPR),
• The transfer is necessary for the assertion, exercise, or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data (Article 6(1)(f) GDPR).
Shipping service providers:
For the delivery of ordered goods, we pass on your name and delivery address to the shipping service provider commissioned by us. The legal basis is Article 6(1)(b) GDPR.
Payment service providers:
For the processing of payments, we pass on the required payment data to the credit institution commissioned with the payment or to the payment service provider selected by you. The legal basis is Article 6(1)(b) GDPR.
10. Google Analytics
This website uses Google Analytics, a web analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics uses cookies that enable an analysis of your use of the website.
Google Analytics is only activated with your express consent pursuant to Article 6(1)(a) GDPR. Without your consent, no analysis cookies are set and no data is transmitted to Google. You can withdraw your consent at any time via our cookie consent banner.
We use the “Anonymize IP” (IP Masking) function, so that your IP address will be shortened by Google within Member States of the European Union. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

11. Newsletter
When you subscribe to our newsletter, we use the required data (at least your email address) to regularly send you our newsletter. The legal basis is your consent pursuant to Article 6(1)(a) GDPR.

12. Email Advertising without Newsletter Subscription
If we receive your email address in connection with the sale of goods and you have not objected, we reserve the right to regularly send you offers for products similar to those already purchased by email. The legal basis is Section 7(3) of the German Act Against Unfair Competition (UWG) in conjunction with Article 6(1)(f) GDPR.

14. Right to Object
